The barratry of the shipmaster in early modern law: polysemy and mos Italicus

2019

Summary ‘Barratry’ is a polysemic term: it means deceit, bribe, simony, and fraud of the shipmaster. This article seeks to trace the origins of the word and to explore its different meanings, focusing especially on the influence that older meanings had on the development of more recent ones. This operation is of particular importance to understand the meaning of barratry that would appear for last – that of fraud of the shipmaster. By the time civil lawyers started dealing with maritime barratry, they were already well familiar with the other meanings of the term.

2009

The essay deals with the problem of the unification of international maritime law by virtue of maritime international customary rules (lex mercatoria maritima). The first part focuses on the underpinnings of the application of customary international law in different countries and, in particular, in Italy and France, then on the evolution of international maritime law as a mixed legal system, drawing from civil law sources, even in England. The second part of the essay deals with the problem of unification of maritime law in Canada, which, as a mixed legal system, owing to the existence of a civil law system in the Province of Québec, could be observed as a “laboratory” of the relationship …

Problematical aspects of the remedial perspective

2009

Civilians and Insurance: Approximations of Reality to the Law

2015

In the study of the history of insurance, much attention has been paid to early modem jurists. Their importance as a source for the study of the subject is, however, debatable. Early modem jurists were more interested in systematising insurance than in describ ing it for what it was. Their main effort lay in explaining this non-Roman contract in Roman law terms.
